Understanding Criminal Law
It is a commonly held misconception that only “criminals” need a criminal lawyer. However, experience has shown that otherwise good and productive members of society sometimes need legal counsel from an attorney who practices criminal law. In recent decades, the number of possible criminal offenses has increased dramatically. Behaviors that I personally engaged in, or was otherwise exposed to as a boy, have since become illegal.
By way of an example, New Jersey Governor Chris Christie recently signed legislation that revises New Jersey’s car seat laws. As of September 2015, when the new law takes effect, a child under the age of two (2) or under thirty (30) pounds must be in a rear-facing car seat. Children ages two (2) to four (4) must be in a car seat that is either rear-facing or forward-facing, with a five-point restraint. The third category of this new law covers children ages four (4) to eight (8) and requires a child under fifty seven (57) inches tall to be in a booster seat.
This new car seat legislation is only one example, among many, of newer offenses with which the public may be unfamiliar. Consequently, a person could inadvertently run afoul of the law, despite being an otherwise conscientious citizen. In such circumstances, it is important for a person accused of breaking a criminal, quasi-criminal or motor vehicle law, to retain competent counsel.
Admittedly, not all of our clients fall into the scenario outlined above. There are some who are accused of serious criminal activity. In those cases, the team at the law firm of Gruber, Colabella and Liuzza will aggressively advocate on behalf of our client. Remember, in the United States, the burden of proof is on the State. A good defense is based not on proving the innocence of an accused, but based on establishing reasonable doubt.
