    When should you report an accident to your insurance company?

    Immediately! Get your report to the insurance company as close to the time of the accident as possible because this decreases the likelihood of them denying your legitimate claims. If you choose to wait, it opens the door up for doubt and scrutiny on the part of your insurer which we do not want to see happen. Also, your insurance company may offer services that can help you in the immediate aftermath of a serious accident, so it’s in your best interest to pursue these benefits which you’ve most likely been paying for this whole time.

    Am I entitled to compensation to pay for my pain and suffering due to an accident?

    This is a very complicated area. In New Jersey it depends upon the type of insurance policy that you elected to take.

    There are two major distinctions in this area. Policies are flagged as either “Limitation on Lawsuit” or as “No Limitation on Lawsuits.” Those with the former coverage have opted to limit their rights to make a claim or file a lawsuit against another driver for pain and suffering  unless their injury meets one of the following criteria:

    2. Dismemberment
    3. Significant Disfigurement or Scarring
    4. Displaced Fracture
    5. Loss of a Fetus
    6. Permanent Injury (injury to a body part that has not and will not heal to function normally).
